Despite claims by Keurig, a redesign of its plastic K-Cup products did not make them suitable for all curbside recycling.

The agency said Keurig, in its financial filings, had claimed its pods could be “effectively recycled” but didn’t note that two big recycling companies wouldn’t accept them.

The Securities and Exchange Commission said Tuesday that it has charged Keurig Dr Pepper with making inaccurate statements about the recyclability of its K-Cup pods.

Keurig Dr Pepper agreed to a settlement with federal regulators Tuesday, after being charged in a civil case with misleading investors about the recyclability of its K-cups.

The company claimed its pods could be recycled anywhere, even though the two biggest recycling companies in the U.S. said they wouldn’t take them, regulators said.

Keurig, the company behind the popular home brewing and single-serving coffee maker systems, will pay the SEC a $1.5 million civil penalty after it failed to disclose concerns from two major recycling companies about the K-Cup pods in its annual reports.

Keurig agreed to pay $1.5 million in penalties — without admitting guilt or denying the SEC's findings that the K-Cup pod producer made inaccurate claims regarding the recyclability of those pods.
